France’s Tax Authority Can Now Sell Crypto on Platforms

⏱️ 4 min de lecture

France’s tax authority can now seize crypto assets held on registered platforms and sell them directly to cover unpaid tax debts. The measure, introduced by the law of 25 June 2026, marks a significant escalation in how the government can enforce crypto tax obligations.

For investors, the key point is simple: crypto is not beyond the reach of tax collectors. If tax liabilities remain unpaid, assets held through a compliant platform could potentially be sold without the owner manually completing the transfer.

What Does the New French Crypto Seizure Law Mean?

Under the new rules, France’s tax administration can ask a crypto platform to seize assets belonging to a taxpayer with outstanding obligations. The platform may then sell those assets, with proceeds used to settle the relevant tax debt.

Think of this like a bank account used to pay an unpaid bill. Instead of waiting for the taxpayer to transfer money, the authority can take funds from the account and apply them to the debt. Crypto differs because ownership records, transactions and balances may be spread across several wallets or exchanges, making collection more difficult. The new provision gives tax officials an additional enforcement route when assets are visible on regulated platforms.

How Can the Tax Authority Sell Your Crypto?

The procedure is designed to operate through platforms that maintain customer identification and transaction records. These obligations are part of the broader European framework for crypto regulation, including the Markets in Crypto-Assets regulation, commonly known as MiCA.

The tax authority can identify unpaid liabilities and initiate the seizure process. Where an account holds crypto, the platform can freeze or take control of the assets, liquidate them and transfer the proceeds to the public treasury. Depending on the circumstances, the sale may require a court order or another form of legal authorization.

Not every platform or wallet will necessarily be covered in the same way. Self-custodied wallets do not have a traditional account balance that an exchange can deduct automatically. However, assets moved to an exchange for trading, selling or cashing out can become easier for authorities to locate and access.

What Happens to the Remaining Funds?

If the crypto is sold for more than the tax debt, the surplus should generally be returned to the taxpayer after the sale and related costs are settled. Conversely, if the assets are worth less than the debt, the taxpayer may still owe the remaining amount. The new power therefore does not necessarily eliminate the full liability; it provides a way to recover part or all of it from assets already held on a platform.

Why Was the Measure Introduced?

The law responds to a practical enforcement problem. Crypto transactions can cross borders quickly, and tax authorities often lack the tools needed to locate, freeze and sell assets directly. By working through platforms with verified customer records, the government can reduce that gap.

The measure also reflects a broader shift toward stricter oversight of digital assets. Governments increasingly view crypto transactions as taxable financial activity rather than a separate, opaque sector. For established exchanges such as Bitvavo, compliance with identification, reporting and asset-freezing requirements is becoming a core part of operating in the European market.

Does This Apply Only to Crypto on Exchanges?

The most direct impact concerns assets held on regulated crypto platforms. The tax authority cannot reach an exchange in the same way that it cannot automatically access every hardware wallet. Nevertheless, links between wallets, banks and on-chain activity can still provide evidence of taxable income or capital gains.

Self-custody still requires careful record-keeping. A hardware wallet such as Ledger can help users keep private keys offline, but it does not exempt transactions from taxation or remove the need for accurate records. Investors should also document transfers, staking rewards, liquidity provision and every disposal event.

Trading platforms such as Kraken may offer transaction histories and reporting tools that make this process easier. These records can help investors calculate gains, identify missing declarations and respond accurately if a tax inquiry is received.

What Should European Crypto Investors Do?

The new law is a reminder to treat crypto tax compliance as an ongoing responsibility rather than an optional annual task. Investors should take several practical steps:

  • Keep complete transaction records: Preserve purchase prices, sale proceeds, fees, dates and the wallets or accounts involved.
  • Calculate gains consistently: Document disposals, including sales for fiat, exchanges between crypto assets and certain spending activities.
  • Declare relevant income: Include staking, mining and other rewards according to their tax treatment in France.
  • Resolve discrepancies early: Check whether exchanges have reported information that differs from personal records.
  • Maintain secure backups: Protect account access and backup recovery information without sharing private keys with third parties.

Key Takeaways for Crypto Investors

France can now use crypto held on platforms to collect unpaid tax debts, giving authorities a more direct enforcement mechanism. This does not mean every self-custodied wallet can be accessed automatically, but it makes keeping assets on exchanges riskier when declarations or payments are incomplete.

The best response is proactive: maintain accurate records, reconcile platform reports and pay taxes when due. By doing so, investors can reduce the risk of seizure while benefiting from the stronger transparency and security standards developing across Europe’s regulated crypto industry.
